Welcome to jhumka.store (the "Site" or "Platform"). The Site is operated by Jhumka India Private Limited (referred to as "Jhumka", "we", "our", or "us"). By accessing or using our SaaS website building platform, tools, and checkout integrations, you (the "Merchant", "Seller", or "User") agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Account Registration and Security

To use Jhumka, you must register for an account by providing your full name, email address, WhatsApp-active phone number, and choosing a secure password. You agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. SaaS Platform Licenses and Availability

Subject to these Terms and payment of the applicable subscription fees (Starter, Growth, or Business plans), Jhumka grants you a non-exclusive, non-transferable, revocable license to access the Platform, configure storefront templates, and process checkout transactions. We strive to maintain a 99.9% uptime, but do not guarantee uninterrupted availability due to MCX bullion rates refresh syncing or network maintenance.

3. Transaction Settlements & Gateway Integrations

Jhumka integrates with third-party payment gateways like Razorpay, PayPal, and UPI APIs. By connecting your gateway accounts, you authorize Jhumka to reconcile orders, print tax-compliant receipts, and compute platform transaction fees (ranging from 0.5% to 2% depending on your subscription plan tier). All customer refunds, disputes, and chargebacks are the sole responsibility of the Merchant.

4. Merchant Content & Intellectual Property

You retain all intellectual property rights to the catalog images, logos, and descriptions uploaded to your store. By posting content, you grant Jhumka a royalty-free license to render and display your products on your storefront domain and synchronize details to WhatsApp Business catalogs.

5. Prohibited Uses

Merchants may not use Jhumka to sell illegal, counterfeit, or unlicensed precious metals, conflict diamonds, or items that infringe upon third-party copyrights. Jhumka reserves the right to terminate accounts that violate local Indian trade regulations.

6. Governing Law & Dispute Resolution

These Terms of Service are governed by the laws of India. Any legal dispute or claims arising out of the use of Jhumka's services shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
